Terms of Use
This document exists in Czech, Ukrainian, Russian, English, Romanian and Filipino. The Czech version is the legally binding one; the other language versions help with understanding the text.
1. Introductory provisions
These terms govern the use of the DOMLUV.TO service at domluv.to and app.domluv.to and in Telegram. The service is operated by [name of the controller – to be filled in by the operator], [address of the controller – to be filled in by the operator] (“we”). Contact:
.
By signing in (with an email code, with Google or with Telegram) you agree to these terms. Anyone who only opens an agreement through a link and replies to it is bound by these terms to the extent of what they do through the link.
2. What the service is and is not
DOMLUV.TO is for writing down and confirming a job agreement between two people and for keeping its history. We are not a party to your agreements, we do not act as an intermediary for work, we do not send or receive money, we do not issue invoices and we do not deal with taxes or insurance.
The parties to an agreement alone are responsible for its content, for carrying it out and for meeting their legal obligations (for example tax, insurance or employment obligations). A job marked as done in the app does not mean it has been paid for.
3. Account
Anyone over 16 may create an account. Give true information and protect access to your email, Google or Telegram account, because that is how you sign in to your account. You are responsible for activity in your account.
4. Rules of use
In the service it is forbidden to:
- enter content that is unlawful, offensive, threatening or harassing;
- enter other people’s personal data without authorisation – your contacts should include only people you are actually making agreements with;
- upload anything other than photos related to an agreement, in particular harmful files;
- get around limits, security measures or content checks, scrape data automatically or overload the service;
- pretend to be someone else.
Text meant for the other side may be checked automatically; the service rejects a clearly offensive message and says why. If the rules are broken, we may hide content or block the account.
5. Your content
Texts, photos and other content remain yours. You grant us a non-exclusive right to store them, show them to the other side of the agreement, translate them by machine and otherwise process them to the extent needed to provide the service, for as long as we keep them under the privacy policy.
If you enter data about another person into the service, you are responsible for being allowed to do so, and you should let them know that you are entering it; they will find a link to the privacy policy in the agreement you send them.
6. Links to agreements
Anyone who has the link can read the agreement and reply to it. So send it only to the person it is meant for. You can create a new link at any time; the previous one then stops working.
7. Translations and automatic processing
Translations and form pre-filling are produced by a machine and may contain errors. The original text, shown next to the translation, always applies. Check the agreement before you confirm it.
8. Price and availability
We charge no fees for using the service in its current form. We provide the service as it is and do not guarantee that it will be available without interruption; we may change, add or discontinue features. If we were to introduce paid features, we would tell you in advance.
9. Liability
We are not responsible for the content of agreements, for carrying them out or for the conduct of the other side. We are liable for damage caused by the operation of the service to the extent set by law; this does not affect consumer rights that cannot be limited by contract.
10. Termination
You can delete your account in your profile at any time. We may close or block an account for a serious or repeated breach of these terms. Agreements you have sent remain with the other side in anonymised form, as described in the privacy policy.
11. Changes to the terms
We may change these terms. We will tell you about a significant change at least 30 days in advance in the app or by email. If you do not agree with the change, you can delete your account before it takes effect; by continuing to use the service you accept the change.
12. Governing law and disputes
These terms are governed by the law of the Czech Republic. This does not take away from a consumer the protection given by the mandatory rules of the country where they normally live. The Czech Trade Inspection Authority (Česká obchodní inspekce), www.coi.gov.cz, is responsible for out-of-court resolution of consumer disputes. Send complaints and suggestions to us at
.
13. Language versions
These terms are available in Czech, Ukrainian, Russian, English, Romanian and Filipino. In the event of any conflict, the Czech version prevails.
